Welcome, and thanks for trying our app. These Terms of Service ("Terms") are a legal agreement between you and Seamus Mountain Ventures, LLC ("we," "us," or "our"), a Pennsylvania limited liability company, and they govern your use of Group Trip and Meal Planner and PackSmarter (together, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. Beta Service — Provided Free of Charge
The Service is currently in Beta and is provided to you free of charge. This means:
- Features may change, break, or be removed without notice.
- Data loss can occur; keep your own copies of anything important.
- Availability and support are best-effort, with no uptime guarantees.
- We reserve the right to introduce paid features, subscription tiers, usage limits, or other charges at any time in the future. If we do, we will give you reasonable advance notice and you may choose whether to continue using any paid portion of the Service.
2. Eligibility
You must be at least 13 years old to create an account. If you are under the age of majority where you live, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. The Service is not directed to children under 13, and we do not knowingly collect personal information from them.
3. Your Account
You can create an account with your email address or by signing in with Google. You are responsible for keeping your credentials secure and for all activity that occurs under your account. Please notify us promptly if you suspect any unauthorized use. You agree to provide accurate information and to keep it reasonably up to date.
4. What the Service Does
The Service helps groups plan trips together. Depending on the trip, you and your co-planners may use it to:
- Plan meals, generate grocery lists, and coordinate cooking duties
- Track expenses, cost-share, and settle up between members
- Build packing lists and shared group gear (via PackSmarter)
- Coordinate travel, lodging, itineraries, and to-do items
- Invite others to a trip and collaborate in real time
- Receive optional email digests and push notifications
5. Your Content
You retain ownership of the content you create in the Service (meals, notes, comments, lists, expenses, and similar). By adding content to a shared trip, you grant us a limited license to store, display, and process it as needed to operate the Service and to make it visible to other members of that trip. You also grant other members of that trip the ability to view, and where relevant edit, the shared content of that trip.
You are responsible for the content you add and for having the right to share any information about other people (including guests) that you enter into the Service.
6. Acceptable Use
You agree not to:
- Use the Service for anything unlawful, harmful, harassing, or abusive
- Upload content that infringes someone else's rights or privacy
- Attempt to break, reverse engineer, or circumvent security or access controls
- Scrape, spam, or overload the Service, or use it to send unsolicited messages
- Impersonate another person or misrepresent your affiliation
We may suspend or terminate accounts that violate these Terms, at our discretion.
7. Planning Aids Are Estimates Only
The Service provides planning aids such as suggested grocery quantities, packing list templates, bag-weight estimates, weather forecasts, and cost splits. These are estimates for planning purposes only and may not reflect real-world conditions. In particular:
- Bag-weight estimates in PackSmarter are approximate and may differ from your actual bag weight. We are not responsible for airline baggage fees, overweight charges, or delays resulting from reliance on those estimates.
- Weather data is provided by third parties and may be inaccurate or delayed.
- Cost-sharing and settlement calculations are for coordination between friends and family. They are not financial, tax, or accounting advice, and we do not process payments.
- Allergy and dietary warnings depend on information you and other members enter. Always verify allergens and ingredients directly for anyone with a medical condition.
8. Third-Party Services
The Service relies on third-party providers (for example, cloud hosting, email delivery, and weather data). If you sign in with Google, your use of Google's service is subject to Google's own terms and privacy policy. We are not responsible for the acts or omissions of third-party services.
9. Termination
You may stop using the Service and delete your account at any time by contacting us at ContactUs@SeamusMountainVentures.com. We may suspend, restrict, or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or if we discontinue the Service. Content you contributed to shared trips may remain visible to other members after you leave, since it is part of the shared group data.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of data loss.
11. Limitation of Liability
To the fullest extent permitted by law, Seamus Mountain Ventures, LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability to you for any claim arising out of or relating to the Service will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless Seamus Mountain Ventures, LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms.
13. Changes to the Service and to These Terms
We may add, change, or remove features of the Service at any time. We may also update these Terms from time to time — including to introduce pricing, paid tiers, or other commercial terms after Beta. When we make material changes, we will update the effective date and version at the top of this page and, where appropriate, notify you in the app or by email and ask you to re-accept the updated Terms. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of them.
14. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict-of-laws principles. You and we agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction of those courts.
15. Miscellaneous
These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remaining provisions will remain in full effect. Our failure to enforce a right or provision is not a waiver. You may not assign these Terms without our written consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
